D)   NEGLIGENCE OR WILLFUL MISCONDUCT.

11.3 The provisions of Sections 5, 6, 7, 8.3, 9, 10, 13, and 17 shall survive the termination or expiration of these T&Cs and shall remain in full force and effect.
